<p>Back to our regularly scheduled post:</p>
<p>This Friday 5 May 2017 should be marked in your calendar or journal as a&nbsp;momentous date when the EU Official Journal will publish the Medical Device and In-Vitro Diagnostic Regulations and the transition periods for both start (3 years for the MDR &amp;&nbsp;5 years for the IVDR)!! &nbsp;This is the start of a turning point for many medical device and IVD manufacturers as the clock starts ticking away til the end of the transition periods of these new Regulations. &nbsp;If you haven&#8217;t started your transition planning strategies for your products&nbsp;&amp; product families the pressure should be mounting quickly as there is so much to deal with for this transition time.&nbsp;<a href="http://bit.ly/EU_MDR_IVDR_FinalText">Check out these resources for learning more about the MDR &amp; IVDR.</a>&nbsp;See below for some more details about the challenges you need to consider and <span style="color: #ff6600;"><em><strong>START PLANNING for NOW (don&#8217;t wait)</strong></em>!</span></p>
<p><span style="color: #ff6600;"><em><strong>There is no grandfathering once the transition period ends</strong></em></span> for the applicable Regulation. &nbsp;So, in 3 years and a day or so if you don&#8217;t meet the MDR or 5 years &amp; a day or so if you don&#8217;t meet the IVDR you won&#8217;t&nbsp;be able to CE Mark your device and sell or&nbsp;distribute your medical or IVD device in the EU (&amp; <a href="http://bit.ly/BrexitMedDvcImplications" target="_blank" rel="noopener noreferrer">hopefully&nbsp;the UK which is in the middle of Brexit</a> implications as UK will not be part of the EU by end of transition period).</p>
<p>We have talked about some of the challenges in&nbsp;the implementation of the MDR but here are more details to consider for your strategic planning:</p>
<ul>
<li>New&nbsp;definitions to deal with including nanomaterial, Unique Device Identifier, interoperability, economic operator, among other new &amp; modified definitions.</li>
<li>Person Responsible for Regulatory Compliance: Identify personnel that is &nbsp;responsible for regulatory compliance with the Regulation and have a minimum work experience in the applicable device field and a minimum of academic qualifications.</li>
<li>Enormous Single EU Database (not ready yet): Impacts all Economic Operators (which includes manufacturers) &#8211; Will register <em><strong>all</strong></em> devices, manufacturers, Economic Operators, CE Certificates, new clinical investigations,&nbsp;&amp; incident reporting. &nbsp;Will manage all Unique Device Identifications and Single Registration Numbers (SRN).</li>
<li>Regulations are much more explicit now for the Quality Management System (QMS) &amp; Risk Management System (RMS) requirements. &nbsp;Beyond just what is in EN 13485 (ISO 1385:2016) &amp; EN 14971</li>
<li>Economic Operators (new to MDR): Impacts the activities of EU Representatives, Importers, Distributors &amp; Manufacturers &#8211; Different Responsibilities depending on type of Economic Operators.</li>
<li>Traceability of Devices Between Economic Operators: Between all Economic Operators (<span style="color: #ff6600;"><em><strong>wow that in itself can be huge!</strong></em></span>) and all the way down to the healthcare institutions &amp; in some cases down to the patients devices used on.</li>
<li>Annex I now called Safety &amp; Performance Requirements (not Essential Requirements): Much more prescriptive, addition of UDI &amp; SRN to labelling requirements, all manufacturers will need to update all their Annex I checklists, new Clinical Evaluation &amp; Clinical Performance Evaluations requirements</li>
<li>Clinical Data: Much more prescriptive especially for higher risk class devices (class III &amp; implantable&nbsp;devices) &#8211; Clinical Investigations needed in many cases now &amp; restrictions of the type of clinical data allowed for class III devices (much more restrictive using equivalency data), post market clinical follow-up requirements for high risk class devices (i.e. annual summary reports for Class III &amp; implantable devices).</li>
<li>Notified Bodies: Much more prescriptive in competency requirements, conflict of interest, designation process, etc. &nbsp;The end result is fewer Notified Bodies &amp; Notified Bodies with narrower scopes after the designation process. &nbsp;Also, with the nexus of &nbsp;the EU regulations, Canada&#8217;s MDSAP requirements, and medical device manufacturers transitioning to ISO 13485:2016 the Notified Bodies resources are being strained which means less resources available to the medical device manufacturers. The limited resources means it may be a challenge to&nbsp;complete these processes without hitting the edge or past the&nbsp;transition period so start now or you may not be able to keep all your CE medical devices on the EU market in about 3 years from now when the clock runs out.</li>

The answer isn’t exactly yes or no. </span></p>
<p><span style="font-size: small; font-family: arial, helvetica, sans-serif;">The end of the transition period for 2<sup>nd</sup> ed. of IEC 60601-1 is June 30, 2013.  By July 1, 2013 I hope you will be using the 3<sup>rd</sup> ed. based standard for your FDA premarket submissions declarations of conformity.  Are you ready for this transition period and where is the transition information located?</span></p>
<p><span style="font-size: small; font-family: arial, helvetica, sans-serif;"><span id="more-3179"></span>The answer is that the IEC version of 60601-1 isn’t a Recognized Consensus standard after the end of the transition period for 2<sup>nd</sup> ed. of IEC 60601-1.  FDA will allow the 2nd ed. of IEC 60601-1:1988 + A1: 1991 + A2:95 (Recognition Number 5-4, Recognition List #013) up til the end of the transition period of June 30, 2013 but the transition period isn’t noted in this entry of the Recognized Consensus Standards list.  So, where do you suppose it is located?  One could search for a very long time and not come up with the answer, as the FDA database for Recognized Consensus Standards is not flexible when it comes to search terms.  You need to know to search for the US national version of the standard, which is the AAMI ES version.  Also, the entries for the 3<sup>rd</sup> ed based US national version of IEC 60601-1 vs. the 3<sup>rd</sup> ed. + A1 national version of IEC 60601-1 aren’t in the database the same way.  One is in the database as ‘ES60601-1’ and the other is ‘ES 60601-1’.</span></p>
<p><span style="font-size: small; font-family: arial, helvetica, sans-serif;">So, as of now you can start to use the ANSI/AAMI ES 60601-1:2005/(R)2012 and C1:2009/(R)2012, including the A2:2010/(R)2012 (Consolidated Text), <em>Medical electrical equipment &#8211; Part 1: General requirements for basic safety and essential performance </em>[Recognition Number 5-71, Recognition List #029] OR ANSI/AAMI ES 60601-1:2005/A1:2012 [Recognition Number 5-74, Recognition List #030] <strong><a href="http://www.eisnersafety.com/fda-eu-mdd-aimdd-ivdd-updated-standards-lists/" target="_blank" rel="noopener noreferrer">Recognition list #030 was issued on 15 Jan ’13</a></strong>.  Up to and thru June 30, 2013 you can also use the 2<sup>nd</sup> ed. of IEC 60601-1 [Recognition Number 5-4, Recognition List #013].  In the Extent of Recognition section of both ES 60601-1 standards you will find a sub-section titled “Transition:” which states:</span></p>
<p style="padding-left: 30px;"><span style="font-size: small; font-family: arial, helvetica, sans-serif;">“FDA recognition of <strong><span style="text-decoration: underline;">Edition 2:1988</span></strong> (A1:1991+A2:1995) <strong><span style="text-decoration: underline;">of IEC 60601-1</span> </strong>is <strong><span style="text-decoration: underline;">hereby superseded</span></strong> <strong><span style="text-decoration: underline;">by recognition of ANSI/AAMI ES60601-1:2005</span></strong>, Medical Electrical Equipment &#8211; Part 1: General requirements </span><br />
<span style="font-size: small; font-family: arial, helvetica, sans-serif;"> for basic safety and essential performance. <strong><span style="text-decoration: underline;">FDA will accept declarations of conformity</span></strong>, in support of <strong><span style="text-decoration: underline;">premarket submissions</span></strong>, <strong><span style="text-decoration: underline;">to Edition 2:1988</span></strong> (A1:1991+A2:1995) of IEC 60601-1 <strong><span style="text-decoration: underline;">until June 30, 2013</span></strong>. <strong><span style="text-decoration: underline;">After</span></strong> this <strong><span style="text-decoration: underline;">transitional period</span></strong>, <strong><span style="text-decoration: underline;">declarations of conformity to Edition 2:1988</span></strong>(A1:1991+A2:1995) of the standard <strong><span style="text-decoration: underline;">will not be accepted</span></strong>.”</span><br />

										<content:encoded><![CDATA[<p>On June 1, 2012 Japan issued their national version of IEC 60601-1:2005 (or 3rd ed.).   The transition period has started as of June 1, 2012 but I am still determining what products under Japan&#8217;s MHLW&#8217;s (Ministry of Health, Labour and Welfare) 4 class system (Class I &#8211; IV) will be required to meet this standard by end of the transition period<span id="more-2551"></span> of May 31, 2017.  More details to come as soon as I obtain more information on the subject.</p>

<p><span style="font-size: small;"><span style="font-size: small;"><span style="font-family: arial, helvetica, sans-serif;">On October 1, 2011 the DRAFT &#8220;FAQ related to Implementation of EN 60601-1:2006 Clarification of open issues&#8221; was issued and this <a title="EN60601-1 Implementation ISSUES final draft for NB-MED V1.0" href="http://www.eisnersafety.com/wp-content/uploads/2011/10/EN_60601-1_Implementation_ISSUES_final_draft_for_NB-MED_V1-0.pdf">DRAFT document</a> is being sent to <a href="http://www.team-nb.org/" target="_blank" rel="noopener noreferrer">NB-MED</a> for commenting on the document.  <a href="http://www.team-nb.org/" target="_blank" rel="noopener noreferrer">NB-MED</a> is also known as <a href="http://www.team-nb.org/" target="_blank" rel="noopener noreferrer">TEAM NB</a>.  This organization is the European Association of Notified Bodies for Medical Devices which covers the MDD (93/42/EEC), AIMDD (90/385/EEC), and IVDD (98/79/EC).  This group publishes guidances that are agreed on by the Medical Device Directives (93/42/EEC, 90/385/EEC, and 98/79/EC) Notified Bodies. Once all the responses are agreed to it is anticipated that the document will be released as an NB-MED guidance document.</span></span></span></p>

<p style="padding-left: 30px;"><strong><span style="font-size: small;"><span style="font-size: small;"><span style="font-size: small;"><span style="font-family: arial, helvetica, sans-serif;">History </span></span></span></span></strong></p>
<p style="padding-left: 30px;"><span style="font-size: small;"><span style="font-size: small;"><span style="font-size: small;"><span style="font-family: arial, helvetica, sans-serif;">During spring 2011, it was realized that the use of EN 60601-1 and its many family members in demonstrating compliance with the relevant and applicable requirements of the European medical device regulatory framework was not too trivial. While relevant guidance on the matter had been published at the CENELEC website as a Q&amp;A document (click here), some Notified Bodies were giving advice that was felt to be not in line with that guidance. On other occasions, questions were raised that were not covered in the guidance.</span></span></span></span></p>
<p style="padding-left: 30px;"><span style="font-size: small;"><span style="font-size: small;"><span style="font-size: small;"><span style="font-family: arial, helvetica, sans-serif;">So, it was concluded that the situation for electrical equipment in medical practice was not totally clear and that additional guidance would be useful. Further contact with the chair of the NB-MED confirmed this desirability, and a small group of experts was established. This group developed an enquiry asking for &#8220;practical issues in the implementation&#8221;, that was sent to many stakeholders in June 2011(see Annex 1). Also at the international level of IEC the request was distributed (62A/769/INF).</span></span></span></span></p>
<p style="padding-left: 30px;"><span style="font-size: small;"><span style="font-size: small;"><span style="font-size: small;"><span style="font-family: arial, helvetica, sans-serif;">The response to the request was beyond expectation and the small team of experts, initially consisting of three, was expanded with Dr. Klaus Neuder of DKE (Frankfurt, Germany).</span></span></span></span></p>
<p style="padding-left: 30px;"><span style="font-size: small;"><span style="font-size: small;"><span style="font-size: small;"><span style="font-family: arial, helvetica, sans-serif;">End of July 2011, the work on digesting the issues submitted until then started and it took until end of September 2011 until all material had been thoroughly discussed and answers formulated to the questions that were raised. In some cases, the questions were slightly amended to make them a little more general, and a few additional &#8220;connecting&#8221; questions were developed by the team.</span></span></span></span></p>
<p style="padding-left: 30px;"><span style="font-size: small;"><span style="font-size: small;"><span style="font-size: small;"><span style="font-family: arial, helvetica, sans-serif;">It is believed that the answers, developed in close team cooperation, present a fair response to the issues brought forward and that they can be used as a reference for all stakeholders.</span></span></span></span></p>
<p style="padding-left: 30px;"><span style="font-size: small;"><span style="font-size: small;"><span style="font-size: small;"><span style="font-family: arial, helvetica, sans-serif;">Now it is time for the NB-MED to scrutinize the proposed responses and see if they are also acceptable to all members of NB-MED. <p>When the transition period was defined for EN IEC 60601-1:2006 (replacing the 1988 version with its two amendments), several questions arose. These questions were included in a FAQ document that was posted at the CENELEC web site (click <a href="http://www.cenelec.eu/aboutcenelec/whatwedo/technologysectors/medicalequipment.html">here</a>) to give all users the same interpretation<a href="#_ftn1">[1]</a>: (click <a href="file://localhost/ftp/::ftp.cencenelec.eu:CENELEC:TCs:CollateralStandardsMDD.pdf">here</a>).</p>
<p>The transition period, after which only the 2006 edition will be giving presumption of conformity with the relevant Essential Requirements of the Medical Device Directive (93/42/EC), is now well underway. As an increasing number of manufacturers are implementing this version of the standard, more questions come up. In particular this is the case in conversations between manufacturers and involved authorities or Notified Bodies considering CE-conformity purposes.</p>
<p>In an attempt to support these discussions, and to harmonize responses, we are looking for specific matters that have arisen and that may have wider relevance. Together with regulatory experts, we will seek answers to those matters that reflect a consensus opinion of the Medical Notified Bodies. Clearly, this is <strong><span style="text-decoration: underline;">not</span></strong> a request for technical matters, e.g., for required test conditions, but rather unclear situation. A few examples of such matters are given in the annex.</p>
<p>If you know of such matters, or even have experienced some yourselves, please share these. If you have reached agreement on these matters or you have proposals for the same, and wish to share: these are also very welcome. As indicated, the matters will be compiled and given to experts for sound advice, followed by scrutiny from NB-MED experts, resulting in the best available recommendations for the matters indicated. This advice will be made publicly available.</p>

<p><strong>Annex – Examples of questions sought</strong></p>
<p><strong>Q1. Valid EC Design-Examination certificate period vs. DOCOPOCOSS: 2012-06-01:</strong><br />
 Example: Suppose an MDD class IIB or III electrical medical equipment was placed on the EEA in 2009. It has a signed EC Design-Examination Certificate by a NB based on 2Ed EN 60601-1, valid until 2014-01-01 (five years).</p>
<p>Question: Is this product affected by the DOCOPOCOSS related to EN 60601-1:1990 (+ am1 + am2), June 1st 2012? Keep in mind that a valid EC certificate has been issued by a NB which is valid 5 years up to 2014.</p>
<p><strong>Q2. Future totally new particular standards:</strong><br />
 For a specific MEE does not exist a specific particular standard related to 2Ed EN 60601-1. However, for this specific MEE a totally new particular standard related to the 3Ed EN 60601-1:2006 is work in progress. This question is relevant at least for: <br />
 &#8211; 60601-2-63: for dental extra-oral x-ray equipment,<br />
 &#8211; 60601-2-64: light ion accelerators,<br />
 &#8211; 60601-2-65: for dental intra-oral x-ray equipment,<br />
 &#8211; 60601-2-66: hearing aids and hearing systems</p>
<p>Officially such MEE’s shall fulfil the complete 3Ed EN 60601-1:2006 plus the relevant particular standard 60601-2-XY at the date 2012-06-01, unless there is a specific transition period for the applicable particular standard. Usually no specific transition period for the totally new particular standards are defined in the OJ, therefore, 2012-06-01 will apply.</p>
<p>Is there any guidance beyond the general advice to discuss specific problems related to the application of these new standards with the NB and using Risk Management?</p>
<p>Can 3 years transition period for the EN 60601-2-XY be claimed starting from publishing the EN version of the particular standard?</p>
<p><strong>Q3. Is ZLG paper 3.5 A1 legally binding for EU NB’s and MEE manufacturers:<br />
 </strong>The ZLG-paper 3.5 A1 addresses a valid concern extremely clear: <em>&#8220;The missing new assessment by the manufacturer after the end of the &#8220;doc&#8221; or the missing knowledge about the existing of new harmonized standards or scientific knowhow are substantial NON-conformities. If these NON-conformities will not be adequate corrected, the certificates have to be suspended or withdrawn.”</em><br />
 Is this paper legally binding? Am I allowed to ignore it? In clear words: If the “doc” is over and I have not objective evidence about the new 3Ed EN 60601-1:2006 requirements in a point-by-point protocol format, is my NB forced to suspend or withdraw my CE-certificate?</p>
